1. Acceptance of the Terms

By accessing or using Hybtra (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, use requires parental consent.

3. Accounts & Security

• You are responsible for safeguarding your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• We may suspend or terminate accounts that violate these Terms.

4. User Content

"User Content" means prompts, text, data, or other materials you upload or create in the Service. You retain ownership of your User Content. By posting User Content, you grant Hybtra a worldwide, non-exclusive, royalty-free licence to store, display, reproduce, and distribute it solely for the purpose of operating and improving the Service.

You represent and warrant that you have all rights necessary to grant this licence.

5. Acceptable Use

You agree not to:

• Upload unlawful, harmful, or infringing content;
• Reverse engineer or attempt to access the Service's source code;
• Interfere with or disrupt the Service or its security;
• Use the Service to train AI models without explicit permission;
• Sublicense or resell Service access.

6. Subscription & Payments

• Paid plans are billed via our payment partner Dodo Payments. Prices, billing cycles, and cancellation terms are presented at checkout.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time in Settings. Access remains until the end of the current billing period; no refunds are provided for partial periods except where required by law.

7. Intellectual Property

The Service, including software, text, graphics, and trademarks, is owned by or licensed to Hybtra and is protected by intellectual-property laws. Except as expressly allowed, you may not copy, modify, or create derivative works.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Hybtra does not warrant that the Service will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Hybtra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues, whether incurred directly or indirectly. In no event shall our aggregate liability exceed the greater of (i) USD 50 or (ii) the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Hybtra and its affiliates from any claim arising out of your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users or us.

12. Modifications to the Terms

We may update these Terms from time to time. We will post the updated Terms and indicate the "Last updated" date. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Delaware.
